A Woman Is Suing Her Mother’s Doctor For Millions Of Dollars Because He Allowed Her To Be Born

A UK woman is suing her mother’s former doctor for negligence, claiming that if he did his job properly, she wouldn’t have been born.

Evie Toombes, a 20-year-old showjumping star, suffers from spina bifida, a birth defect that occurs when the spine and spinal cord don’t form properly.

The condition requires her to perform daily physiotherapy for up to three hours. She also relies on a catheter to use the washroom and must be fed by a tube because of her stomach issues.

Toombes wants millions in damages from Dr. Philip Mitchell. She claims the doctor failed to advise her mother to take a supplement that could have prevented the birth defect.

She says that if her mother had been told to take the supplements, she would have delayed getting pregnant until she had taken them.

Her mother, who saw Dr. Mitchell in February 2001, says they discussed folic acid supplements, but he did not stress their importance in preventing spina bifida.

According to Toombes, if it were not for the negligence of the doctor, she would never have been conceived and ‘her damage and disability are due to this.”

Dr. Mitchel denies this and says he gave reasonable advice.

Despite her condition, Toombes has gone on to a successful career in horse showjumping, as well as being a published author.

In 2018 she won the Inspiration Young Person Award at a charity event. She was also awarded a British Citizen youth award and medal.
